QUESTION: .What is an encyclopedia definition of Exclusive Buyer Agent?
ANSWER: From Wikipedia, the free encyclopedia:
"An Exclusive Buyer Agent (or EBA) is a United States real estate firm (or an agent or broker who works in such a company) which represents only buyers of real estate."
"As such, they are distinguished from all other real estate firms by their business model of 100% buyer representation."
"The EBA movement started in the late 1980's and, by the early 1990s as with the rise of Buyer agency in general in US states, firms came into being and a national trade association, the National Association of Exclusive Buyer Agents, was formed. As of 2008, EBA firms now offer service to buyers in almost all 50 states."
"While some states have created various forms of DUAL AGENCY to allow one company to represent both sides, other states have made it illegal."
Dual Agency is still practiced by traditional Realtors in Ohio - but buyers and sellers must give written consent. Undisclosed Dual Agency remains illegal in all 50 states.
THE BUYER'S AGENT, Buyer Broker Real Estate Dayton, Ohio does not practice Dual Agency, because we practice Exclusive Buyer Agency ONLY. |

| When
a traditional Realtor tells you they can be your
"buyer agent," you should ask them, "Can you
prove it?"
|
The
traditional Realtor works at a company that takes
listings of homes and usually represents the seller,
but the majority of traditional agents will act
as a Dual
Agent
and also represent a buyer of the same property.
Consequently, neither party is truly "represented"
due to the conflict of interest. The Exclusive
Buyer Agent (EBA) works for a company that does
not take listings of any kind, and represents
buyers only.
|
| BEFORE
seeing ANY homes with ANY
Realtor, every Buyer should ask these QUESTIONS:
1. Do
you, or does your company, take listings
of homes for sale? Do you practice Dual
Agency or Split Agency?
2. If
you and your company take listings, how
can you fully represent buyers? Dont
you represent your sellers?
3. If
we met at your Open House, and I wanted
to buy that house, arent you required
to negotiate price and terms in favor
of your seller?
4. At
private showings, do you point
out reasons for NOT buying a house, even
when its one of YOUR listings?
5. On
the Ohio
Agency Disclosure Statement,
do you usually represent: a) The buyer
as the buyers agent; b) The
seller as the sellers agent; or
c) The buyer AND the seller at the same
time? [Note: c) is Dual Agency]
6. Arent
you required to promote your sellers'
listings first, or your companys
listings first, before showing me any
homes that are listed for sale with other
real estate companies?
7. Can
I have a copy of your company's "Consumer
Guide to Agency Relationships,"
and will the Guide contain the fact that
you company practices Dual Agency, and/or
Split Agency, because your company lists
homes for sale, and represents sellers?
8. In
the past year, how many buyers have you
represented...exclusively? How many
Dual Agency, Split Agency, and/or "in-house
transactions" were you involved with?
Can I have the names and the phone numbers
of six of your most recent buyer-clients?
9. What
clauses will you include in the purchase
contract to protect me as a buyer? Can
you show me those clauses?
10. How
will you help me save money, and how will
you protect my interests during my transaction,
even if I choose one of your sellers'
homes to buy?
|
|
|
|
A
traditional real estate agent, or Realtor, or "buyer
agent"
who
works for a company that "sells" real estate in the
Dayton, Ohio area
CANNOT guarantee to ALWAYS represent YOUR interests.
A
genuine Exclusive
Buyer Agent
will GUARANTEE in writing to
always "represent your interests exclusively throughout
the transaction
and help you negotiate the lowest price."
