What is the definition of Exclusive Buyer Agency?

The definition of Exclusive Buyer Agency by the National Association of Realtors (NAR) and the National Association of Exclusive Buyer Agents (NAEBA): "Exclusive Buyer Agency: The practice of representing only buyers and never sellers in a transaction. The company never lists a seller’s property and thus never has a seller as a client."

Don't get fooled by traditional Realtors who claim they can be your "exclusive" buyers agent when they - and their company - have listings of homes to "sell" you.

Big Hill, Century 21, Coldwell Banker, Irongate - they don't have Exclusive Buyer Agency, and neither does Keller Williams, Prudential, Real Living, Re/Max, or Sibcy Cline. None of those Dayton, Ohio real estate companies - and no traditional Realtor from a company that "sells" homes - can legally provide Homebuyers with genuine Exclusive Buyer Agency.

Buy a home with a traditional Realtor, and you could end up having a DUAL AGENT or a SPLIT AGENT.

LESS THAN 1% of all Realtors are genuine Exclusive Buyers Agents. Our real estate companies represent BUYERS ONLY. We protect the Buyer's interests during their purchase, and we always negotiate price and terms in the Buyer's favor. The seller's Realtor CAN'T.

1.  If you attend a "private showing" of a house with a seller’s Realtor, that agent can "claim" you as "their" buyer, and it's often too late for you to choose a genuine Exclusive Buyer Agent (EBA) to fully represent you!

2.  When you, the Buyer, are "claimed" by the seller's Realtor, you can be "represented" either by the seller's Realtor as a Dual Agent, or you get "represented" by another Realtor in the SAME real estate office - as a Split Agent!

3.  According to Ohio law, Buyers do not have to consent to Dual Agency or Split Agency. According to Ohio law, a seller's Realtor MUST tell their seller HOW MUCH a Buyer is willing to pay!

4.  If you visit an Open House, and if you tell the seller's Realtor that you "don't have any agent or Realtor," that agent can "claim" you as "their" buyer, to "represent" both you AND their sellers! But the seller's Realtor MUST remain "neutral" towards Buyers - according to Ohio law!

5.  Before visiting New Homes, you should contact your Exclusive Buyer Agent. If you visit a New or Model Home without your agent, the builder's salesperson-agent can "claim" you as "their" buyer!

MOBILITY Magazine: "Only by using an exclusive buyer agent can a buyer be sure all information is kept confidential. Only an exclusive buyer agent can give the buyer an objective, experienced opinion of the homes viewed to ensure the buyer gets the right home, in the right location, at the right price."

Buyers have a legal right to be fully represented. There's only one type of Agent or Realtor who always works FOR you, the Buyer, never the seller, and never BOTH sides during your real estate purchase. You'll always receive FULL representation, with YOUR interests protected, and your finances kept CONFIDENTIAL - only with a genuine Exclusive Buyer Agent.
