According to Ohio law, the "Agency Disclosure Statement" must be given to a buyer
no later than the
writing of a contract. Prior to 2005, the Disclosure was
required to be given to a buyer when the first meeting occurred
with an agent, except at Open Houses.
If
a Realtor wrote a contract for you, but you were NOT
given the "Agency Disclosure Statement,"
you may want to contact an attorney or the Ohio
Department of Commerce, Division of Real Estate & Professional
Licensing at (614) 466-4100 or
Ohio Division
of Real Estate.
On this Disclosure, the agent(s) and their brokerage(s),
along with the buyers and the sellers, are identified when
your real estate transaction begins. Another purpose for
this Disclosure is for buyers to recognize the limitations
of certain types of agents, and for buyers to give their
consent to those lesser types of representation.
You DO NOT have to consent to Dual Agency!
Dual Agency is a transaction involving one
agent - who will attempt to "represent" both the
buyers and the sellers - but the Dual Agent must
"maintain a neutral position" towards the
buyers! It's true that no man - and no Realtor - can "serve
two Masters." Do you desire to purchase a home
with a "neutral" Realtor?
Split Agency is a real estate transaction involving
two agents - from the same brokerage! That's just
fine for the seller's brokerage - but doesn't that sound
like a conflict of interest for you,
the buyer?
Wouldn't you prefer full representation, from
a genuine Exclusive Buyer Agent who's always
on YOUR side - the Buyer's side - from start to finish?
A genuine Exclusive Buyer Agent believes that buyers
and sellers should be represented by their own agent,
and that each agent should be from separate
real estate companies. We guarantee to never take
listings and to fully represent our buyer - our client
- exclusively, and we guarantee to keep your
financial information and bargaining strategy confidential.
