How can a traditional Realtor truly "represent" any Buyer when they - and their company - have Homes to "sell" you?

TRADITIONAL?

When a traditional Realtor tells you they can be your
"buyer's agent," you should ask them, "Can you prove it?"

The traditional Realtor works at a company that takes listings of homes and usually represents the seller, but the majority of traditional agents will act as a Dual Agent and also represent a buyer of the same property.  Consequently, neither party is truly "represented" due to the conflict of interest.  The Exclusive Buyer Agent (EBA) works for a company that does not take listings of any kind, and represents buyers only.

BEFORE seeing ANY homes with ANY
Realtors, every Buyer should ask these QUESTIONS:

1 Do you, or does your company, take listings of homes for sale? Do you practice Dual Agency or Split Agency?

2.  If you and your company take listings, how can you fully represent buyers? Don’t you represent your sellers?

3.  If we met at your Open House, and I wanted to buy that house, aren’t you required to negotiate price and terms in favor of your seller?

4.  At “private showings,” do you point out reasons for NOT buying a house, even when it’s one of YOUR listings?

5.  On the Ohio Agency Disclosure Statement, do you usually represent: a) The buyer as the buyer’s agent;  b) The seller as the seller’s agent; or c) The buyer AND the seller at the same time? [Note: c) is Dual Agency]

6.  Aren’t you required to promote your sellers' listings first, or your company’s listings first, before showing me any homes listed with other real estate companies?

7.  Can I have a copy of your company's Consumer Guide to Agency Relationships?

8.  In the past year, how many buyers have you represented exclusively?  Can I have the names and the phone numbers of six of your most recent buyer-clients?

9.  What clauses will you include in the purchase contract to protect me as a buyer? Can you show me those clauses?

10.  How will you help me save money, and how will you protect my interests during my transaction, even if I choose one of your sellers' homes to buy?

Only one type of Agent or Realtor will always negotiate price and terms in favor of the Buyer: a genuine Exclusive Buyer Agent. The members of the National Association of Exclusive Buyer Agents (NAEBA) represent Buyers only.

Remember...

Buyers do not have to consent to Dual Agency or Split Agency, and a seller’s agent MUST tell their sellers HOW MUCH a Buyer is willing to pay.

You have a LEGAL right to be fully represented. An Exclusive Buyer Agent (EBA) always works for you, must negotiate for you alone, must legally put YOUR interests first - never the seller's. Get FULL representation, with YOUR interests protected, and your finances kept CONFIDENTIAL - only with a genuine EBA.
